Your account information will be kept strictly confidential. It is never sold, given away, or shared with a third party unless required by law.
Communications from JFM Concepts
You may receive the following types of communications from JFM Concepts: email receipts, system alerts (such as planned outages, system improvements, version updates), abuse warnings, important customer service information, and automated responses to help & trouble tickets. We may send a brief survey email, requesting your feedback on how your issue was resolved. We use this information to improve our customer service. JFM Concepts does have an email newsletter. If you have opted into this communication and no longer wish to receive it, there will be an “opt-out” mechanism in the communication.
"Data Protection Laws" means any laws applicable to you or JFM Concepts, relating to data security, data protection and/or privacy, including but not limited to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to processing of Personal Data and the free movement of that data ("GDPR").
"Personal Data" means any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified directly or indirectly by referencing an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
Each party will comply with Data Protection Laws (as defined above). Without limiting the foregoing, each party will:
- Not use or share Personal Data received from the other party (or its customers) for a purpose for which it has not obtained consent;
- Establish independent procedures for managing and responding to any communication from a customer seeking to exercise its rights under Data Protection Laws;
- Provide reasonable assistance to the other in responding to any requests, investigation, consultation, or claims from a customer, regulator, or supervisory authority concerning Data Protection Law;
- Take appropriate security measures that are required by Data Protection Law, and in accordance with good industry practice relating to data security;
- Refrain from transmitting unsolicited commercial communications in any manner that would violate applicable laws.
In the event of a conflict between this section (Data Protection) and other policies the section that offers greater protection for Personal Data will apply.
Information and Data Collection
We do not share your personally identifiable information with any 3rd parties. We temporarily store session information, so that registered users do not have to login every time they visit the site.
We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process.
We use other third parties to handle secure credit card transaction processing and data storage. When you make purchases, we send your billing information as necessary for the third party to process your order and store relevant data for recurring billing.
Collection and Distribution of Information
We may collect information concerning non-personal marketing statistics from our customers' campaigns (such as response rates, opt-in rates, and ROI), and assemble reports that can be used to compare performance. No personally identifiable information is provided with these reports.
We reserve the right to collect and retain certain information on individual prospects that may be required for the operation of our software, to identify individual prospects who respond to campaigns, for serving the correct variable content, and for the generation of reports.
We reserve the right to collect and disclose any other information relating to the use of our website and software. We do not release information linking individual prospects to specific companies or marketing campaigns to third parties unless required by law.
JFM Concepts accounts require username and password to log in. When you're finished using the system, click the "log out" link to prevent someone from using your computer to access your account.
If you post any personally identifiable information in a blog, forum etc, then this data may be displayed publicly.
